1. Scope and who we are

Cannes Yachts For Rent operates the website ohiolmsc.org and arranges crewed day charters and longer charters on yachts and boats based in and around Cannes, from day-boats to superyachts, with day rates starting at €1,700. These terms apply to every charter booked through our enquiry form, by email, by phone or by WhatsApp. For any question about a booking or about these terms, write to [email protected].

2. From enquiry to confirmed booking

Nothing is booked, and no payment is taken, directly on the website. You send us an enquiry through the online form, or you contact us by email, phone or WhatsApp, telling us the yacht you are interested in, your preferred dates, the number of guests, and anything else we should know. We reply with a written quote covering the charter price and anything extra that applies to your trip. A booking only becomes firm once we have confirmed it to you in writing and received the deposit described below. Until that point, any availability we mention is indicative and may change.

3. Prices and what is included

The price quoted to you covers the charter of the yacht with its crew for the agreed hours or days, as set out in our written quote. Fuel, marina fees, the advance provisioning allowance (APA) that applies on larger yachts, catering, and any other optional extras are charged separately, exactly as listed in that quote. We do not add charges that were not quoted to you in writing.

4. Payment and deposit

Your booking is confirmed once we receive a deposit equal to 50% of the charter price. The remaining balance is due 7 days before departure. If the balance is not received by that date, we may treat the booking as cancelled by you, and the cancellation terms below apply.

5. Cancellation and changes by you

If you cancel more than 14 days before departure, you receive a full refund. If you cancel between 7 and 14 days before departure, you receive a 50% refund. If you cancel less than 7 days before departure, no refund is due. You may change your charter dates once at no cost, provided you ask more than 7 days before departure and the new dates are available on the yacht concerned; further changes are treated as a new booking request.

Under European consumer law, the 14-day right of withdrawal that normally applies to distance contracts does not apply here, because a yacht charter is a leisure service supplied on a specific date (Directive 2011/83/EU, Article 16(l); in France, Article L221-28 of the Consumer Code). This is why we offer the voluntary cancellation tiers set out above instead of a statutory withdrawal period.

6. Cancellation by us

If the captain or the relevant port authority considers conditions unsafe for your charter, for reasons of weather, sea state, a technical issue with the yacht, or any other case of force majeure, you choose between a free new date or a full refund. The captain's assessment of safety is final and is not open to negotiation on the day.

7. Guest capacity and safety rules

The number of guests on board can never exceed the licensed capacity of the yacht, as stated in our quote and confirmation. The crew may refuse to let anyone board, or may ask anyone to disembark, if that person's conduct or condition endangers the safety of guests, crew or vessel.

8. The captain's authority and itinerary

The captain is in command of the yacht at all times and has full authority over navigation, safety and the itinerary. A requested itinerary, including routes toward the Lérins Islands, the Esterel coast or Monaco, is followed whenever weather, sea conditions and timing allow, but the captain may change course, shorten the trip or return to port early if safety requires it. Such a change does not, by itself, entitle you to a refund beyond what is set out in the weather and safety clause above.

9. Conduct on board and damage

You and your guests are expected to follow the crew's instructions at all times, particularly on matters of safety. You are responsible for damage caused to the yacht, its equipment or its tender by you or your guests through negligence or misuse, beyond normal wear and tear, and such damage may be charged to you separately from the charter price.

10. Personal belongings and liability

You and your guests are responsible for your own personal belongings brought on board; we do not accept liability for their loss, theft or damage. Our liability for any claim relating to your charter is limited to the amount actually paid for that charter, except for death or personal injury caused by our negligence, for which liability is not limited.

11. Complaints, website use, and governing law

If something about your charter was not as agreed, tell us as soon as possible, ideally while still on board or within a few days of your trip, by writing to [email protected], so we can look into it properly. The content of ohiolmsc.org, including yacht descriptions, photographs and pricing information, is provided for the purpose of informing enquiries and bookings and may not be copied or reused without our permission.

These terms are governed by French law. Any dispute that cannot be resolved directly between us is subject to the exclusive jurisdiction of the French courts. We may update these terms from time to time to reflect changes in our services or in the law; the version published on ohiolmsc.org at the time of your booking applies to that booking.
